- Recorder Webster opened the meeting of the Certification for the Town of Bath Municipal Election of June 10, 2025. She informed Council that there had been no submittals to contest the Board of Canvass results of June 17, 2025.
MOTION: To certify the Town of Bath Municipal Election results as presented by the Board of Canvass- Skinner/Hickey- Carried

- CALL TO ORDER: By Recorder Webster at 4:45. Due to the absence of the Mayor nominations for Mayor Pro Tempore were accepted for this meeting. MOTION: To appoint Councilman Greg Schene to serve as Mayor Pro Tempore for this Board of Canvas meeting – Hickey/O’Connell- Carried.

- Recorder Webster opened the Board of Canvass for the Town of Bath Municipal Election of June 10, 2025. The Board compared the number of ballots cast with the number of ballots tabulated. Election materials, equipment and results were reviewed.
- Three (3) provisional ballots were appropriately presented. Each ballot was reviewed for compliance with the acceptable standards of the WV Secretary of State.
- By Common Consent, Council concurred to accept and count two (2) of the provisional ballots presented.

The preparations for the 2025 Election have started.
The Election will be held Tuesday, June 10, 2025. Early voting begins on May 31st and ends June 7th. Last day to register to vote is May 20th.
Offices on the ballot will be Mayor, Town Recorder and all five council members.
Candidate filing dates are April 1st to April 12th. There is a $5 filing fee. Forms are available at Town Hall, 271 Wilkes Street in Berkeley Springs, or see below.
Requirements: 18 years or older, Town resident for over a year, no Felony charges. A resident would be someone that lives full time in the Town of Bath, that has real, or property tax assessed for the year proceeding the election, is listed as a legal voter and has documentation such as a valid driver’s license as proof.
These are volunteer positions, there is no monetary compensation.
There is a spot on the Candidate form for party affiliation, but it’s not mandated to fill that out.
Current office holders are Scott Merki, Mayor, Susan Webster, Town Recorder, and Council Members Mary Lynn Hickey, Rebecca MacLeod, David O’ Connell, Greg Schene and Elizabeth Skinner.

Challenging a Candidate’s Eligibility:
Neither the municipal recorders nor the governing bodies have the authority to make judgments about whether a candidate meets the eligibility requirements. Sometimes an opposing candidate will attempt to pressure the filing officer to take someone off the ballot based on information that the person is not a resident or is not eligible for some other reason. Only the “party-switching” provision provides a mechanism for refusing certification. Otherwise, eligibility can be challenged in only two ways: (1) by a court (Circuit Court) proceeding seeking the candidate’s name be removed from the ballot before the election or afterward; or (2) by contesting the election (with Municipal Governing Body) if the candidate in question wins.
The Town of Bath would like to announce that the following people have signed up to serve on the next Council. Please plan on coming out on Election Day June 13th and show your support.
Mayor – Scott Merki. Recorder – Susan Webster. Council Members Rob Campbell, Rev. Bob Emerick, Thomas (Tom) Hall, Mary Lynn Hickey, Rebecca MacLeod, David O’ Connell, Greg Schene and Elizabeth Skinner. Write in Candidate Joseph Giles.
All officers serve a two (2) year term effective 7/1/23 – 6/30/25. The municipality will be governed by a Mayor, Recorder and five (5) Council Members.
If you are interested in running, you may be a write –in candidate, applications need to be received by 5pm on 4/18/23 at the Town Office.
The deadline to withdraw your candidacy is 4/28/23.
